Probate Administration

Probate is a legal process through which the assets of a deceased person are properly distributed to the heirs or beneficiaries under a will, or if there is no will, according to Florida law.  A probate action is usually filed in the county in which the deceased lived, and the Court oversees the administration of the estate to make sure debts are paid and proper distribution is made.

There are different types of probate proceedings, and it would be wise to seek legal advice before deciding which type of proceeding is appropriate.  For example, a Formal Administration is filed when there are assets exceeding $75,000.00 and/or when it is necessary to appoint Personal Representative to act on behalf of the estate.  A Summary Administration does not require the appointment of a Personal Representative, and may be filed when the entire estate value is under $75,000.00.  A Disposition of Personal Property Without Administration is filed to request a release of decedent’s assets to reimburse the person who paid the decedent’s final expenses, such as funeral bills and medical bills.
